customs law, trade and tax sanctions, all kinds of related investigations,
disputes and related litigation; trade violation of intellectual property
rights, data privacy and data protection compliance. Proceedings concerning
the granting of duty-free treatment under free-trade agreements, such
as the North American Free-Trade Agreement and the Generalized System
of Preferences, export licensing proceedings before the US. Department
of Commerce and the Office of Foreign Assets Control of the Treasury Department
and duty savings and avoidance programs, such as drawback, temporary importation
under bond, customs bonded warehouses, and foreign-trade zones are also
covered.
We assist our clients in customs law litigation and any other issues related
to customs law before the European Commission and the European Court of
Justice as well as before the European national courts and the national
customs agencies. We assist companies in penalty proceedings put forward
by European Customs Agencies or other agencies for alleged violations
of customs laws and regulations both on the customs law, criminal and
civil sides, and we are able to take action or support sovereign States
and private undertakings before the World Customs Organization.
With the recent opening of the Washington coordination business office,
the Firm expanded its international presence to the benefit of clients
operating in progressively integrated markets. Our goal is to assist European
and non-US undertakings in better coordinating their customs and trade
compliance in the US market as well as in litigation related matters.
In cooperation with local US lawyers admitted before the US jurisdiction,
TCA Attorneys assists and coordinates foreign clients’ actions in proceedings
under Section 301 of the Trade Act of 1974 concerning the enforcement
of U.S. rights under trade agreements and in response to foreign practices
before the Office of the U.S Trade Representative, as well as in proceedings
against unfairly traded imports under Section 337 of the Tariff Act of
1930, as amended (patent, copyright and trademark infringements). We also
deal with proceedings related to the protection of registered copyrights
and trademarks before U.S. Customs and relevant federal courts.
